focal point photography - the contract

the purpose of this contract is to protect the photographer {me} and client {you} equally

Payment: A session fee is required to hold your scheduled appointment time. The session fee is non-refundable, but very transferrable. IT DOES NOT COVER ANY PRINTS OR DIGITAL IMAGES.

Photographer: The Photographer agrees to provide the Client with an online gallery of the edited photos within 2 weeks of the scheduled shoot. The Photographer may make reproductions for her portfolio, social media sites, samples, self-promotions, entry in photographic contests or art exhibitions. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client. The Photographer agrees to keep a copy of the Client’s digital images in the studio for a period of time up to one year from the date of the photo shoot.

Client: Within 2 weeks, the Client will receive an email with directions on how to view their online gallery containing the final edited version of the photographs taken at their scheduled appointment. The Client's gallery will be live for 4 weeks. During this time, the Client may share the link with friends and family. Anyone (with the code) may order prints during this time. IF digital images are purchased, the Client may have the files printed at a lab of their choice. The Photographer is not responsible for any images that are printed from the purchased digital images. A print release will accompany the DVD/USB of purchased digital images.

Failure to Perform: If the Photographer cannot perform this Agreement due to fire or other casualty, act of God, inclement weather, or other cause beyond the control of the parties, or due to the Photographer’s illness, every effort will be made to reschedule the appointment at the Client’s convenience. The Photographer shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of the Photographer.

Price List: The price list is listed on the website and may be adjusted periodically. Future sittings shall be charged at the prices in effect at the time the sitting appointment is made.

Miscellany: This Agreement incorporates the entire understanding of the parties. Any modifications of the Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. The Agreement shall be governed by the laws of the State of Washington.

Both parties have read the contract terms and conditions, agree to all its terms, and Client acknowledges this by placing their initials under each paragraph
